The Utah Department of Workforce Services is the Service Workforce Agency (SWA) for Department of Labor Employment and Training (DOLETA) Foreign Labor Certification H-2A, H-2B, and Prevailing Wage programs.
Foreign labor certification programs are generally designed to assure that the admission of foreign workers to work in this country on a temporary basis will not adversely affect the job opportunities, wages and working conditions of U.S. workers. The program titles link to the regulations which govern each program. The Department of Labor is responsible for administering programs for prevailing wages for, H-1B Specialty (Professional) Workers, H-2A Temporary Labor Certifications, and H-2B Temporary Labor Certifications.

The role of the Utah Department of Workforce Services is to provide information and assistance to employers’ applying for H-2A, H-2B programs and determine prevailing wages. The Department of Labor, through its regional certifying offices, has the statutory responsibility for making labor certification determinations.
