UI Fraud Convictions 2007 and 2008

On July 30, 2008, the Fourth District Court, Provo, Utah County, State of Utah, found the defendant Jimmy Shuler guilty of fraudulently obtaining unemployment compensation, a Third Degree Felony reduced from a Second Degree Felony. The defendant is ordered to serve 0-5 years in the Utah State Prison; sentence suspended. The defendant is to serve 90 days in the Utah County Jail. The defendant is to serve 90 days in the Utah County Jail; may serve the jail term in the GPS Monitoring Program. Once the defendant has paid full restitution and statutory penalty of $11,230, the conviction may be reduced to a Class A Misdemeanor.


On June 23, 2008, the Third District Court, Salt Lake Department, Salt Lake County, State of Utah, found the defendant, Ricky Shane Kemp, guilty to Attempted Unemployment Compensation – False Statement, a third degree felony, amended from a second degree felony. Based on the defendant’s conviction, the defendant is sentenced to a term of not to exceed five years in the Utah State Prison. The prison term is suspended. The defendant was placed on probation for 36 months, with conditions. The defendant must pay restitution of $7,655 for the fraud overpayment and $8,209 for the civil penalty. The defendant is to pay a minimum of $200 per month directly to the Department of Workforce Services, beginning July 23, 2008.


On June 13, 2008, the Third District Court, Salt Lake County, State of Utah, found the defendant, Thomas Wayne Schnoor, to Attempted Unemployment Compensation – False Statement, amended to a Class A Misdemeanor from a third degree felony. Based on the defendant’s conviction, the defendant is sentenced to a term of 365 days in jail. The total time suspended for this charge is 365 days. The defendant was placed on probation for 36 months. On June 6, 2008, the Third District Court, Salt Lake Department, Salt Lake County, State of Utah, found the defendant, Brooke S. Ackerman, guilty to Attempted Unemployment Compensation – False Statement, a Class A Misdemeanor, amended from a third degree felony. Based on the defendant’s conviction, the defendant is sentenced to a term of 365 days in jail. The jail sentence was suspended for 365 days. On May 5, 2008, the Fourth District Court, Provo, Utah County, State of Utah, found Richard L. Hilliard guilty of fraudulently obtaining unemployment compensation, a Third Degree Felony reduced from a Second Degree Felony. The defendant was ordered to serve 0-5 years in the Utah State Prison. On April 7, 2008, the Third District Court, Salt Lake Department, Salt Lake County, State of Utah, found the defendant, Sonia Moreno, guilty to Attempted Unemployment Compensation – False Statement, amended to a Third degree felony from a second degree felony. Based on the defendant’s conviction, the defendant is sentenced to an indeterminate term of not to exceed five years in the Utah State Prison. The prison term is suspended. The defendant was placed on probation for three (3) years, with conditions. The defendant must pay restitution of $10,362 at a rate of $235.00 per month. On March 12, 2008, the Fifth District Court, St. George, Washington County, State of Utah, found Adam Albert Thompson guilty of fraudulently obtaining unemployment compensation, a Third Degree Felony. The defendant is ordered to serve 0-5 years in the Utah State Prison. Sentenced stayed. The defendant was order to pay restitution in the amount of $7,660 to the Department of Workforce Services. The defendant was placed on supervised probation for a period of 36 months, with conditions.


On February 25, 2008, the Third District Court, Salt Lake County, State of Utah, found the defendant, Lany Phanthalangsy guilty to Attempted Unemployment Compensation – False Statement, a third degree felony, amended from a second degree felony. On February 7, 2008, the Fourth District Court, Provo Department, Utah County, State of Utah, found Kevin G. Gurney guilty of Unemployment Compensation-False Statement, a Third Degree Felony. The plea is held in abeyance. The defendant was ordered to pay restitution in full to the Department of Workforce Services in the amount of $6,950.


On January 9, 2008, the Sixth Judicial District Court, Manti, Sanpete County, State of Utah, found Shane N. Sorensen guilty of Attempted Unemployment Compensation Fraud – False Statement, a Third Degree Felony. The defendant submitted payment of restitution in full, $6,161 to the Court on behalf of the Department of Workforce Services.

On December 17, 2007, the Third District Court, Salt Lake Department, Salt Lake County, State of Utah, found Eliapo Makeni Alo guilty to Attempted Unemployment Compensation – False Statement, amended to a Class A Misdemeanor from a third degree felony. Based on the defendant’s conviction, he was sentenced to 365 days in jail. The total jail time was suspended. The defendant was placed on probation for a period of 36 months. The defendant must pay restitution of $3,598.00 for the fraud overpayment and a civil penalty of $3,598.00, for a total amount of $7,196.00, on behalf of Department of Workforce Services.


On December 7, 2007, the Third District Court, Salt Lake Department, Salt Lake County, found Patricia Sepulveda guilty to Attempted Unemployment Compensation – False Statement, a Class A Misdemeanor. The charge was amended from a third degree felony. Defendant was sentenced to 365 days in jail. The total jail time was suspended. The defendant was placed on probation for a period of 24 months court probation. The defendant must complete 25 hours of community service. The defendant must pay full restitution in the amount of $4,276 and a civil penalty of $4,596, for a total of $8,872. The restitution and penalty must be paid through Workforce Services at a rate of $175 per month.

On December 7, 2007, the Third District Court, Salt Lake Department, Salt Lake County, found Adam Michael Hunsaker guilty to Attempted Unemployment Compensation – False Statement, a Class A Misdemeanor. The charge was amended from a third degree felony. Based on the defendant’s conviction, he was sentenced to 365 days in jail. The total jail time was suspended. The defendant was fined $750, which includes the surcharge (of $358.11). The defendant was placed on probation for a period of 36 months. The defendant must perform 100 hours of Community Service in lieu of jail time. The Court will suspend the fine upon successful completion of probation. The defendant must pay full restitution in the amount of $6,062 through Workforce Services at a rate of $300.00 monthly.


On December 3, 2007, the Third District Court, Salt Lake Department, Salt Lake County, State of Utah, found the defendant, Annie Hutchison, guilty to Attempted Unemployment Compensation – False Statement, a Class A Misdemeanor. The charge was amended from a third degree felony. Prior to the sentencing, the defendant paid off the entire fraud overpayment amount of $3,150.00 and the penalty amount of $3,150.00 for a total of $6,300.00. Because of this, the defendant’s guilty plea will be held in abeyance for a period of twelve (12) months. The defendant must complete 100 hours of community service, which must be completed by November 3, 2008.


On November 26, 2007, the Third District Court, Salt Lake Department, Salt Lake County, State of Utah, found Jeremy Scott Beus guilty to Attempted Unemployment Compensation – False Statement, amended to a Class A Misdemeanor from a third degree felony. Based on the defendant’s conviction, he was sentenced to 365 days in jail. The total jail time was suspended. The defendant was placed on probation for a period of 36 months, with conditions. The defendant must pay restitution of $3,623.00 on behalf of the Department of Workforce Services. The defendant is to pay restitution at a rate of at least $100.00 per month beginning January 1, 2008. The State will not object to termination of probation upon payment of restitution and will not object to 402 reduction upon payment of restitution and civil penalty.


On November 16, 2007, the Fourth District Court, American Fork, Utah County, found Chad Dyer guilty of fraudulently obtaining unemployment compensation, a Third Degree Felony. The plea will be held in abeyance for a period of 12 months. The defendant was ordered to pay restitution in the amount of $6,720 to the Department of Workforce Services. The defendant has paid said amount to the court. Upon completion of the plea in abeyance period, the charges will be dismissed on the motion of either party.


On November 13, 2007, the Fifth District Court, St. George Department, Washington County, State of Utah, found Brennen Lee Tsosie guilty to Unemployment Compensation – False Statement, a third degree felony. Based on the defendant’s conviction, he was sentenced to an indeterminate term of not to exceed five years in the Utah State Prison. The prison term is suspended. The defendant was fined $9,275, all of it being suspended. The defendant was placed on probation for a period of 36 months and is to be supervised by Fifth District Court. The defendant must pay restitution in the amount of $3,564, which is the fraud overpayment only, on behalf of Department of Workforce Services. The defendant must pay at a rate of $100.00 per month commencing January 2, 2008 and continuing on a monthly basis until paid in full.


On November 6, 2007, the Fifth District Court, St. George, Washington County, found Lisa Frederick guilty of Attempted Unemployment Compensation Fraud – False Statement, a Class A Misdemeanor, reduced from a Third Degree Felony. The defendant is sentenced to a term of one year, time suspended. A fine of $1,875 was ordered and suspended. The defendant was ordered to pay restitution to the Department of Workforce Services in the amount of $4,354. The defendant presented a check to the Court in that amount. The defendant is placed on probation for 18 months.


On November 2, 2007, the Third District Court, Salt Lake Department, Salt Lake County, State of Utah, found the defendant, Eric Bruce Nielson, guilty to Attempted Unemployment Compensation – False Statement, amended to a third degree felony from a second degree felony. Count two was dismissed. The defendant is sentenced to an indeterminate term of not to exceed five years in the Utah State Prison. The prison term is suspended. The defendant must pay restitution on behalf of Workforce Services in the amount of $33,355.50, at a rate of $450.00 per month. The defendant was placed on probation for 36 months, with conditions.


On October 17, 2007, the Fifth District Court, St. George, found Paul S. McAllister guilty of Attempted Unemployment Compensation Fraud-False Statement, a Third Degree Felony. The defendant is sentenced to an indeterminate term of not to exceed five years in the Utah State Prison. The prison term is suspended. The defendant was ordered to pay restitution to the Department of Workforce Services in the amount of $7,350 at a rate of $150 per month. The defendant is placed on probation for 36 months. Defendant to serve 30 days in jail, which must be completed by December 2008.


On September 5, 2007, the Seventh Judicial Court, Castle Dale, found Chantel Brown guilty of Attempted Unemployment Compensation Fraud-False Statement, a Class A Misdemeanor, reduced from a Third Degree Felony. Defendant to be placed on a plea in abeyance for a period of 12 months. In no event shall the defendant’s probation terminate prior to the time the defendant has completely paid restitution. The defendant was ordered to pay restitution to the Department of Workforce Services in the amount of $7,202 at a rate of $200 per month until paid in full. A review date is set for September 3, 2008.


On August 27, 2007, the Third District Court, Salt Lake Department, Salt Lake County, State of Utah, found Genevieve Eleanor Billie guilty to Attempted Unemployment Compensation – False Statement, amended to a Class A Misdemeanor from a third degree felony. Based on the defendant’s conviction, she was sentenced to 365 days in jail. The total jail time was suspended. The defendant was placed on probation for a period of 36 months. The defendant must pay full restitution of $9,520.00, which represents a fraud overpayment of $4,760.00 and a civil penalty of $4,760.00. The defendant must pay $100.00 per month to the Department of Workforce Services each month beginning on September 27, 2007.


On August 24, 2007, Third District Court, Salt Lake Department, Salt Lake County, State of Utah, found the defendant, Jeremy Lee Bishop, guilty to Attempted Unemployment Compensation – False Statement, a third degree felony. Based on the defendant’s conviction, he was sentenced to an indeterminate term of 0 to 5 years in the Utah State Prison. The prison term was suspended. The defendant was placed on probation for a period of 36 months, with conditions. The defendant must pay restitution of $10,234.00, which includes the fraud penalty, to the Department of Workforce Services. The defendant is to pay restitution at a rate of at least $200.00 per month beginning October 1, 2007.


On August 24, 2007, the Third District Court, Salt Lake Department, Salt Lake County, State of Utah, found the defendant, Jack D. Johnson, Jr., guilty to Attempted Unemployment Compensation – False Statement, amended to a Class A Misdemeanor from a third degree felony. The defendant was sentenced to one year in jail. The total time for the jail was suspended. The defendant was ordered to pay restitution in the amount of $7,426.00, including the fraud penalty, directly to the Department of Workforce Services, at a rate of $200.00 per month beginning October 1, 2007. (The criminal restitution amount is $3,713.00 and the civil penalty is $3,713.00.) The defendant was placed on three years probation, with conditions, and is to be supervised by Third District Court.


On August 14, 2007, Third District Court, Salt Lake Department, Salt Lake County, found Troy Jay Nichols guilty to Attempted Unemployment Compensation – False Statement, amended to a Third Degree Felony from a Second Degree Felony. Based on the defendant’s conviction, he was sentenced to an indeterminate term of not to exceed five years in the Utah State Prison. The prison term is suspended. The defendant must pay full restitution in the amount of $10,656, which includes the Civil Penalty to Workforce Services. The defendant was placed on 36 months probation, with conditions. If the defendant successfully completes the Probation, the charge can be reduced to a Class A Misdemeanor.


On July 16, 2007, the Third District Court, Salt Lake Department, Salt Lake County, found the defendant, Joshua Aron Willardson, guilty to Attempted Unemployment Compensation – False Statement, amended to a Class A Misdemeanor from a third degree felony. Defendant was sentenced to 365 days in jail; the total jail time was suspended. The defendant was placed on probation for a period of 36 months. The defendant must pay full restitution at a rate of $200.00 per month to the Department of Workforce Services. The defendant owes a criminal restitution of $4,589.00 and a civil penalty of $4,589.00.


On July 2, 2007, the Second District Court, Farmington Department, Davis County, State of Utah, found the defendant, Angela Denise Hingson, guilty to Unemployment Compensation- False Statement, amended to a Class A Misdemeanor from a third degree felony. The defendant was sentenced to 365 days in the Davis County Jail. The total time suspended is 185 days. The commitment is to begin immediately. Credit is granted for the 66 days of time previously served. The defendant may be released upon approval by the Adult Probation and Parole of Interstate Compact to Kansas City. The defendant may participate in a treatment at the WRC (Work Release Center). The defendant was placed on 36 months probation, with conditions, which includes completing a DNA test and paying the fee. The probation is to be supervised by Adult Probation and Parole. The defendant is to serve 180 days in jail and must report immediately to the Davis County Jail. The defendant was fined $2,500.00, of which $1,950.00 was suspended. The defendant must pay a fine of $550.00, which includes the surcharge. The defendant must pay restitution in the amount of $3,332.00 to the Utah Department of Workforce Services. She must pay $1,686.89 to the CCJJ (Criminal and Juvenile Justice) for extradition costs. She must also pay $250.00 to the Public Defender fee Davis County Treasurer. DWS must collect the civil penalty of $3,332.00 by civil means.


On May 22, 2007, the Third District Court, Salt Lake Department, found Paul Darin Adams guilty to Attempted Unemployment Compensation – False Statement. The defendant pled guilty to an amended Count 1, a third degree felony, rather than a second degree felony. Based on the defendant’s conviction, he was sentenced to an indeterminate term of not to exceed five years in the Utah State Prison. The prison term is suspended. He was placed on probation for a period of 36 months, with conditions. The defendant must pay full restitution in the amount of $18,550, which includes a fraud overpayment of $9,275 and a civil penalty of $9,275, on behalf of Department of Workforce Services. Upon payment in full of the restitution, the court will consider reducing the third degree felony to a Class A Misdemeanor.


On May 15, 2007, the Sixth Judicial District Court, Manti, Sanpete County, found Marvin Kinsel guilty of Attempted Unemployment Compensation Fraud – False Statement, a Third Degree Felony, reduced from a Second Degree Felony. The defendant was sentenced to an indeterminate term of not to exceed five years in the Utah State Prison, which was suspended. The defendant was sentenced to serve a term of 90 days in the Sanpete County Jail. The defendant will not need to serve the 90 days in jail, if he pays at least $100 on his restitution by 6/15/07 and every month thereafter. The defendant was ordered to pay a fine of $9,275, which was suspended. He was ordered to pay restitution to the Department of Workforce Services in the amount of $12,614.


On May 4, 2007, the Third District Court, Salt Lake County, found David R. Beasley guilty to Attempted Unemployment Compensation – False Statement, a second degree felony amended to a third degree felony. He was sentenced to a term of 15 days in jail. The total time suspended was 0 days. He was given credit for the time served. The defendant was fined $5,000. The entire fine was suspended. The defendant must pay restitution in the amount of $14,762 on behalf of the Department of Workforce Services. The defendant was placed on 72 months probation.


On April 16, 2007, the Third District Court, Salt Lake Department, Salt Lake County, found Winter Thelma Inglefield guilty of Attempted Unemployment Compensation - False Statements, a third degree felony, amended to a Class A Misdemeanor. The defendant is sentenced to a term of 365 days in jail. The total time suspended for this charge is 365 days. The defendant is placed on probation for a period of 36 months. The defendant is to pay $3,593 in restitution to the Department of Workforce Services at a rate of $150 per month beginning June 4, 2007. The defendant is also to pay $3,593 in a civil penalty to the Department of Workforce Services, for a total amount of $7,186.

The defendant was sentenced to serve one-year jail time, which was suspended. The defendant was ordered to pay restitution to the Department of Workforce Services in the amount of $9,646.


On April 12, 2007, the Second District Court, Farmington Department, found Kriston Heinrich Scott guilty to Unemployment Compensation - False Statements, a third degree felony, amended from a second degree felony. The defendant was sentenced to an indeterminate term of not to exceed five years in the Utah State Prison. The prison term was suspended. The defendant must pay full restitution in the amount of $11,568.50 on behalf of the Department of Workforce Services.
