Employer Appeals

What Are My Appeal Rights?

If you disagree with any decision made by the Department, you have the right to file an appeal. You have the right to appeal both benefit determinations for your former employees and tax status determinations.

All appeals must be submitted in writing. Appeals protesting tax determinations must be filed within 15 calendar days of the date the decision was mailed. Rate appeals must be filed within 30 days of the date on the rate notice.

Appeals from a decision of an Administrative Law Judge may be made to the Board of Review of the Utah Department of Workforce Services. Further appeals are made to the Utah Court of Appeals.

If an appeal of a Department decision is filed by you or the claimant, you will receive a notice of the time and place of the fact finding hearing which will be conducted by an Administrative Law Judge. This is generally your last opportunity to give information; therefore, be sure that the information you give is complete.

Testimony at the hearing is taken under oath (or affirmation) and recorded. At the beginning of the hearing, the Administrative Law Judge will informally discuss the case and the procedures that will be followed.

It is important that you have witnesses with first hand knowledge and documentary evidence at this hearing. Failure to do so could result in an adverse decision and there is no further hearing at which you can present such evidence.

What Must My Appeal Include?

There is no specific appeal form, but your written appeal must contain the following information:

  • Your company name and address

  • Your tax account number

  • The date the appeal was mailed or faxed

  • Statement regarding the basis for your appeal

  • The relief you are requesting

  • Your name, title and signature
